Created through a 1975 executive order, the CFIUS is an interagency committee chaired by the U.S. Department of the Treasury that reviews certain foreign acquisitions, mergers, or takeovers of U.S. businesses to determine the effect of the transaction on national security. The Office of the Under Secretary of Defense for Acquisition and Sustainment (OUSD(A&S)) serves as the U.S. Department of Defense (DoD) CFIUS lead, with support from various DoD components, including the Office of the Under Secretary of Defense for Research and Engineering (OUSD(R&E)).
In this webinar, Mr. Irmie “Ike” Blanton of OUSD(A&S) and Ms. Lirio Avilés of OUSD(R&E) will discuss DoD’s CFIUS role and how the Department reviews foreign investments in key technology areas to address potential technology transfer concerns and maintain America’s technological advantage. Mr. Blanton and Ms. Avilés will provide an overview of CFIUS’s mission, structure, and jurisdiction; DoD’s role in CFIUS; the Department’s case review process; the Foreign Investment Risk Review Modernization Act; and foreign investment trends.
